When you can apply for a Deemed Permitted Boundary Activity Notice

If your land use activity or project is close to a boundary, and you have the neighbouring owners' written approval (Written Approval of Affected Persons), you may apply for a Deemed Permitted Boundary Activity. This application replaces the need to apply for a resource consent for your proposed activity.

 

When you cannot apply for a Deemed Permitted Boundary Activity Notice

You cannot apply for a Deemed Permitted Boundary Activity if you infringe any rule that is not a boundary rule, for example if you infringe site coverage, or the landscaped area. You cannot apply for a Deemed Permitted Boundary Activity if you are undertaking works close to a public boundary. A public boundary includes a boundary with any of the following:

  • a public road or walkway
  • a public open space
  • a stream, river, or lake
  • the coast
  • an esplanade reserve or strip
  • any other reserve
  • any land owned by council or the crown (e.g. public schools).

What you need to apply for a Deemed Permitted Boundary Activity Notice

In order to apply for a Deemed Permitted Boundary Activity, you will need to:

  • supply a document titled ‘Deemed Permitted Boundary Application’, stating the details of your proposal.
  • supply two copies of site plans, drawings and designs for your proposed activity,
    1. one signed by the respective affected person/s, and
    2. an unsigned copy.
  • supply a neighbouring owners' written approval.

How to apply for a Deemed Permitted Boundary Activity Notice

We accept online applications for a Deemed Permitted Boundary Activity Notice. If you are unable to apply online, visit our Customer Service Centre for assistance in making your online application.

If there is no way to provide digital copies of your plans or documents, visit our Customer Service Centre. Our staff will accept your documents for an additional charge. The charge covers costs involved with us scanning your documents into our digital consent system.

What happens next

We will process your application in 10 working days.

A resource consent planner will contact you by email and let you know if you have provided the correct information.

  • If you have, we will approve your application and issue the Deemed Permitted Boundary Activity notice.
  • If you haven't, we will advise you what information is missing and you will need to re-lodge the application.

You cannot appeal or object the decision.
